These Terms and Conditions ("Terms") govern your access to and use of the Station Boss fire department software platform, including the website at www.stationboss.net, the mobile applications for iOS and Android, and all associated services (collectively, the "Service"). The Service is operated by Station Boss ("we," "us," or "our").
By creating an account or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization (such as a fire department or municipality), you represent that you have the authority to bind that organization to these Terms.
1. Acceptance of Terms
By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service. We reserve the right to modify these Terms at any time. We will notify you of material changes through the Service or by email. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.
2. Description of Service
Station Boss provides a cloud-based fire department management platform that includes, but is not limited to:
- Incident reporting and records management (NERIS-compliant)
- Personnel management, certifications, and training records
- Equipment and apparatus inventory, maintenance, and testing
- Shift scheduling and staffing management
- Pre-incident planning and inspection management
- Dispatch notifications and console
- Financial management (accounting, fire dues, cost recovery)
- Mass alert notifications
- Document storage and management
- Reporting and analytics
The specific features available to you depend on your subscription plan. We continuously develop and improve the Service and may add, modify, or remove features at our discretion.
3. User Accounts
To use the Service, you must create an account and provide accurate, complete, and current information. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access or use of your account
- Ensuring that all users within your department comply with these Terms
Department administrators are responsible for managing user access within their organization, including creating and disabling user accounts, assigning roles and permissions, and ensuring that access is granted only to authorized personnel.
4. Subscription and Payment
The Service is offered on a subscription basis. By subscribing, you agree to pay the applicable fees based on your selected plan and user count. Key terms:
- Subscriptions are billed monthly or annually, depending on your selection
- Fees are based on the number of active users in your account
- All fees are quoted in U.S. dollars and are non-refundable except as described in our cancellation policy
- We may change pricing with 30 days advance notice; price changes take effect at the start of the next billing cycle
- Failure to pay may result in suspension or termination of your account
- You are responsible for all applicable taxes
5. Free Trial
We may offer a free trial period for new accounts. During the trial, you have full access to the Service features. At the end of the trial period, you must subscribe to a paid plan to continue using the Service. If you do not subscribe, your account will be suspended. Your data will be retained for 30 days after the trial ends, after which it may be permanently deleted.
6. Acceptable Use
You agree to use the Service only for lawful purposes. You must not:
- Use the Service in violation of any applicable federal, state, or local law or regulation
- Access or attempt to access another user's account without authorization
- Interfere with or disrupt the integrity or performance of the Service
- Attempt to gain unauthorized access to the Service, its servers, or any connected systems
- Upload or transmit viruses, malware, or other harmful code
- Use the Service to store or transmit content that is unlawful, defamatory, obscene, or fraudulent
- Reverse engineer, decompile, or disassemble any part of the Service
- Use automated scripts or bots to access the Service without our written consent
- Resell, sublicense, or redistribute the Service or any part thereof
- Remove or alter any proprietary notices, labels, or marks on the Service
7. Your Data
You retain ownership of all data you enter into the Service ("Your Data"). By using the Service, you grant us a limited license to host, store, process, and display Your Data solely for the purpose of providing and improving the Service.
- We will not access Your Data except as necessary to provide the Service, respond to support requests, or as required by law
- We will not sell Your Data to third parties
- You may export Your Data at any time through the Service's built-in export tools
- Upon termination, Your Data will be available for export for 30 days
- You are responsible for ensuring that Your Data complies with applicable laws, including patient privacy regulations where applicable
8. Intellectual Property
The Service, including its design, code, features, documentation, logos, and trademarks, is the exclusive property of Station Boss and is protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any right, title, or interest in the Service beyond the limited right to use it in accordance with these Terms.
You may not copy, modify, distribute, sell, or lease any part of the Service. You may not use the Station Boss name, logo, or trademarks without our prior written consent.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We do not warrant that defects will be corrected or that the Service is free of viruses or other harmful components. You use the Service at your own risk.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, STATION BOSS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.
11. Indemnification
You agree to indemnify, defend, and hold harmless Station Boss, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) Your Data.
12. Termination
Either party may terminate the subscription at any time. Specific terms:
- You may cancel your subscription through your account settings or by contacting support. Cancellation takes effect at the end of the current billing period.
- We may suspend or terminate your account immediately if you violate these Terms, fail to pay fees, or if we determine that your use poses a risk to the Service or other users.
- Upon termination, your right to use the Service ceases immediately.
- Sections of these Terms that by their nature should survive termination will survive, including intellectual property, limitation of liability, indemnification, and dispute resolution.
13. Service Availability and Modifications
We strive for 99.9% uptime but do not guarantee uninterrupted availability. We may perform scheduled maintenance during off-peak hours with advance notice. We reserve the right to modify, suspend, or discontinue any part of the Service at any time. For significant changes that affect your use of the Service, we will provide reasonable advance notice.
14. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. Any disputes arising out of or related to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.
15. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
16. Entire Agreement
These Terms, together with the Privacy Policy and any applicable subscription agreement, constitute the entire agreement between you and Station Boss regarding the Service. They supersede all prior agreements, understandings, and communications, whether written or oral.
